    Hemp products have been used for hundreds of years, but FDA insists they are a new dietary ingredient. Huh? Action Alert!

    We’ve been monitoring the FDA’s treatment of CBD oil, a cheap, safe, and effective natural medicine for pain and other ailments. The agency has stated that CBD is not a supplement, and part of their justification is that it wasn’t marketed as a dietary ingredient before 1994. Recent evidence has surfaced, however, that clearly shows cannabis was consumed as food for centuries in many different countries. But because of a technicality, it is unlikely that the FDA will consider this evidence that would allow CBD to remain on the market as a supplement—meaning that consumers will have to shell out $32,500 a year for CBD oil.

    My state already officially disregarded the prohibition against adding cannabis to food. All this is perfect nonsense, won't go far. They're dreaming if they think anyone can forbid CBD oil when we can all maker it in our kitchen! And you can order it right now on Amazon.

    I did what I usually do with action items: sent it to the named recipients, which included my state's legislators in Congress. Here is the reply I received from Senator Angus King:

    Dear [Islander],

    I appreciate knowing your interest in loosening the Food and Drug Administration’s (FDA) restrictions on cannabidiol (CBD), which currently is classified as a medicine and cannot be included in food products. I was glad to support a provision of the Senate’s 2018 Farm Bill that de-scheduled all hemp products with less than 0.3 percent THC, including hemp-derived CBD. As you are likely aware the FDA subsequently classified CBD as a medicine, meaning it cannot be added to food products; this decision has created some confusion regarding the sale of CBD products across the country.

    You may be interested to know that the FDA continues to review its regulations surrounding the legalization of CBD in food and drinks, and will be holding a hearing on this subject on May 31. More information on the hearing and an option to comment is available via the following link: https://www.regulations.gov/document?D=FDA-2019-N-1482-0001.

    In March 2019, the State of Maine passed a law that enables CBD to be added to food products within the state, although I understand that the incongruence between state and federal law on this issue must still be addressed. I am currently working with my colleagues to find a solution that properly reflects CBD’s scientifically-established risks and benefits, and I look forward to seeing how the FDA’s position on this issue evolves as they gain input from various stakeholders.
